The fourteen years from 1983 to 1997 constitute the founding era of organized free software: the period in which Richard Stallman translated hacker culture norms into a legally and institutionally durable movement, GNU/Linux coalesced into a viable alternative operating system, and the free software model — built on copyleft and the four-freedoms — became the organizing framework for a global development community.

GNU Project and the Free Software Foundation (1983–1985)

richard-stallman announced the GNU Project in September 1983 with a posting on ARPANET mailing lists. The gnu-manifesto-1983, published in 1985 in Dr. Dobb's Journal, articulated the ethical and practical case for free software: software freedom as a matter of user rights, and mutual cooperation as a development model that would produce better software.

On October 4, 1985, Stallman founded the free-software-foundation to provide the GNU Project with legal and financial infrastructure. The FSF's critical early function was as a copyright holder: if GNU software's copyright was held by the FSF, the FSF could enforce the GPL — the legal instrument Stallman was simultaneously developing to make copyleft enforceable.

By the late 1980s, the GNU Project had produced a substantial tool set: the GNU C Compiler (GCC), the GNU Debugger (GDB), GNU Emacs, GNU Make, and dozens of other utilities. What it lacked was a kernel.

GPL v1 and v2: Making Copyleft Legal

The GNU General Public License v1 appeared in 1989 — the first copyleft license designed to be legally enforceable. GPL v2 followed in June 1991, refining the language and adding the explicit "liberty or death" clause (section 7) that meant GPL software would rather be distributed to no one than distributed under restrictions added by others. The GPL's core mechanism: anyone who distributes GPL software, or derivative works of it, must make the source code available under the same terms. This made it legally impossible to take free software proprietary without violating copyright law.

The GPL translated the cultural norm of sharing into a legal requirement that used copyright — the primary tool of proprietary software — against itself. This was Stallman's central legal innovation, and it gave the gpl-v2 an importance far beyond any particular software project.

Linux: The Missing Kernel (1991)

linus-torvalds posted to comp.os.minix on August 25, 1991, announcing a "hobby" operating system project. The linux-kernel-release-1991 that followed in September 1991 provided what the GNU Project had been missing: a functioning kernel. Initially released under a custom license restricting commercial use, Linux was relicensed under GPL v2 in 1992 — a decision that proved pivotal.

The combination of GNU tools and the Linux kernel produced the GNU/Linux operating system (a naming dispute that itself reflects the software-freedom-vs-open-source tension). Within a few years, GNU/Linux distributions were viable alternatives to commercial Unix variants. The development model that produced Linux — distributed, internet-mediated, with Torvalds as bdfl-governance — would later be theorized by eric-raymond as the bazaar-model.

Debian and Community Distribution (1993)

ian-murdock founded the debian-project on August 16, 1993, as a community-driven Linux distribution committed to free software principles. Debian's subsequent development of the Debian Free Software Guidelines (DFSG) by bruce-perens in 1996 — together with the Debian Social Contract — created the first formal definition of what "free software" meant in practice for a distribution. The DFSG would later be adapted by the Open Source Initiative as the open-source-definition, making Debian's governance work foundational for the broader movement.

Apache HTTP Server (1995)

The Apache HTTP Server, emerging in 1995 from patches to the NCSA httpd server, demonstrated that the free software model could produce dominant commercial infrastructure. By the mid-1990s, Apache was the most widely deployed web server on the internet — running the World Wide Web's expansion. This prefigured the argument that would drive the 1998 open source rebranding: free software worked not just as an ethical stance but as a development methodology that produced superior results.

The apache-software-foundation, founded formally in 1999, would institutionalize this model with a governance structure distinct from both the FSF's model and Torvalds' kernel model.

BSD Lawsuits and the Chilling Effect (1992–1994)

The BSD lawsuits — AT&T/USL suing BSDi and UC Berkeley in 1992, claiming the Berkeley Software Distribution infringed AT&T's Unix copyrights — cast a legal shadow over BSD-licensed Unix derivatives. The settlement in 1994 resolved the litigation, but the years of uncertainty had chilled BSD adoption and redirected developer energy toward Linux, which had no such entanglement. This had a significant licensing-culture effect: GPL copyleft appeared more legally secure than permissive BSD licensing during the critical growth years of early Linux.

By 1997: Viable but Niche

By 1997, GNU/Linux was a technically viable alternative operating system, GPL-licensed software was widely used in production, and the FSF had established the institutional and legal infrastructure of the free software movement. But free software remained a subcultural phenomenon — known to developers and academics, largely invisible to business and mainstream computing.

The transitional event was eric-raymond's cathedral-and-the-bazaar-1997, first presented as a talk in 1997. By arguing that the Linux development model — the bazaar-model — was not just ethically preferable but methodologically superior, Raymond began the reframing that would produce the 1998 open source schism. The era that followed — open-source-schism-and-dotcom-1998-2004 — would see that reframing institutionalized and commercialized.
